TERMS & CONDITIONS
FOR STYLINGS AND WEDDINGS
The client undertakes to read the terms and conditions carefully and fully understand them. The following terms and conditions apply to all orders placed. They are deemed to have been agreed upon unless they are immediately contradicted.
1. General
The subject of the order is the work of the hair & makeup artist for the contractually agreed purpose. A contractual relationship is established exclusively between Joana Greimers (Nice Advice Beauty) and her client.
2. Options/Reservations
Options are reservations for the hair & makeup artist's work for a specified date. The option expires immediately if a firm booking is possible through a third party and the optioned date does not result in a firm booking, even after consulting the client with whom the option was agreed upon.
3. Firm Booking
A firm booking represents a binding order for the hair & makeup artist and the client for the specified date.
a) The booking is made in writing. The contractor confirms the booking in writing by email within the next 7 days.
b) By signing or returning the email, the customer expressly accepts the content of the order confirmation and the general terms and conditions.
c) As confirmation of the reservation and simultaneous payment for the trial appointment, a deposit of €300.00 (three hundred euros) is due. This deposit must be transferred to the Hair & Makeup Artist's account within one week of receiving the invoice.
d) Once the deposit has been paid, the appointment is firmly booked. The Makeup Artist may cancel the appointment if the deposit is not paid within seven days.
4. Cancellation
a) If the Hair & Makeup Artist is unable to fulfill the contract due to force majeure or sudden illness, she will endeavor to find a suitable replacement – but without acknowledging any legal obligation – whereby the price may change by 10% to 20%. The client is not entitled to any compensation claims.
If the client is prevented from attending, the contractor will notify the client immediately by
phone or email.
b) If the booking is not completed or terminated due to the client's fault (except for a breach of contract due to force majeure within the meaning of Section 275 of the German Civil Code), the following provisions apply:
- For cancellations (from the date of the confirmed booking) up to 6 months before the wedding date, the deposit of €300.00 will be retained.
- For cancellations up to 10 weeks before the wedding date, 50% of the agreed price is due.
- For cancellations within 10 weeks before the wedding date, 100% of the agreed fee is due.
c) After the trial appointment, the client has the option of canceling the booking within 24 hours if there are valid reasons for dissatisfaction. No further costs will be incurred, other than the deposit already paid.
5. Styling Cancellations / Styling Times
Styling appointments, even those agreed upon verbally, are considered binding. Upon scheduling an appointment, a service contract is automatically concluded between the client and the contractor. Appointments are binding for both parties. Agreed appointments (including trial appointments) must be canceled at least 72 hours before the scheduled appointment. If an appointment is canceled or postponed at short notice, up to 100% of the styling price may be charged due to loss of earnings.
If the client cannot or does not wish to attend an agreed appointment, the following applies, unless otherwise agreed:
- For services already paid for, there is no entitlement to a refund or partial refund of the paid price.
- For services not paid for, the client remains obligated to pay the agreed service price, but at least a cancellation fee of up to 50% of the price.
- If the customer fails to show up for an agreed appointment without prior notice, the contractor is entitled to charge the customer the full service cost, amounting to 100% of the agreed service price, unless the customer can provide evidence that no such damage has occurred.
- If the customer's delay is so severe that the booked service can no longer be performed without disrupting the schedule and/or if full utilization would result in waiting times for subsequent customers, Joana Greimers reserves the right to charge the full price for the appointment, but to shorten the appointment accordingly so that subsequent customers can be styled and served to their complete satisfaction.
The duration of the service can be found in the offer and price lists. The execution time is only approximate. Time shifts and delays in a styling appointment, regardless of whether they are caused or attributable to the contractual partner, are irrelevant until a deadline of up to 30 minutes has elapsed. The booked styling will be completed within the pre-arranged styling times.
Joana Greimers is not obligated to complete any guest styling sessions that have not been previously agreed upon or registered. Booked guest styling sessions that are not canceled four weeks before the styling appointment are subject to full payment.
6. Liability / Client's Obligations
The client is obligated to inform the hair & makeup artist of any medical conditions or allergies/skin intolerances of themselves or the booked guests. The hair & makeup artist assumes no liability for possible allergic reactions that may occur during or after the service due to the products used. Claims for damages are therefore excluded.
The hair & makeup artist is liable, within the scope of her professional liability insurance, only for personal injury or property damage caused by gross negligence or willful intent during the execution of the service.
7. Payment Terms & Conditions
The following applies to private clients:
- Upon order confirmation and receipt of the first invoice, a deposit of €250.00 is due. For other services, a deposit of 50% is due.
- The total amount shown on the order confirmation (minus the deposit amount), including any actual travel costs and any additional extras (product loans or fillings, etc.), will be shown on a final invoice and must be paid by bank transfer within 7 days at the latest, stating the invoice number.
- Costs for special extras such as hairpieces, hair accessories, etc. are to be borne by the client.
- Joana Greimers is responsible for taxing the fee; the client is not entitled to any deductions.
8. Late Payment Interest
If the agreed payment terms are not met by the client, they shall be liable for any late payment interest (according to the German Civil Code), as well as reminder fees and collection costs.
9. Data Protection / Photos
The client expressly consents to the collection, processing, and use of their personal data. Storage will only occur for the purpose of executing the service. Beyond that, they will not be passed on to third parties.
If photos are taken during styling to document or track the client's styling process, the makeup and hair stylist may only use them for advertising and/or demonstration purposes with the client's prior written consent. The client may revoke their consent to the storage and targeted processing of their data and images at any time in writing or by sending an email.
10. Vouchers
A voucher can be purchased for a specific service and redeemed for available appointments during the service provider's business hours. Vouchers are non-refundable and non-exchangeable.
11. Severability Clause
Any subsidiary agreements or agreements deviating from these Terms and Conditions must be made in writing. If any provision of the contract or these Terms and Conditions becomes invalid, this shall not affect the validity of the remaining provisions and the contract. In place of any invalid provision, a provision that most closely approximates the intended purpose shall be deemed agreed. The same applies to the filling of any gaps in the contract. The law of the Federal Republic of Germany shall apply, even for deliveries abroad. The place of performance and jurisdiction shall be the registered office of the Hair & Makeup Artist, to the extent permitted by law.
